The backstop is part of the draft withdrawal agreement negotiated between Theresa May`s government and the EU. What is the big picture behind the Brexit backstop drama? Barnier told France radio RTL: “Time is too short to find an alternative arrangement to the Irish backstop, and Britain`s divorce deal with the European Union will not be reopened to negotiations.”  In the withdrawal negotiations, the Irish border issue was one of three [c] areas that required a specific flow of negotiations to reach the necessary withdrawal agreement before the future relationship between the UK and the EU could be agreed.    The Irish and British governments, as well as EU officials, have stated that they do not want a hard border in Ireland because they take into account the historical and social “sensitivities” that permeate the island.  It has been argued that the new Withdrawal Agreement will create a “border along the Irish Sea” where goods entering Northern Ireland from Britain will be controlled. RECALLING that the joint report of the negotiators of the European Union and the Government of the United Kingdom on the state of play of Phase 1 of the Article 50 negotiations kills [Treaty on European Union] on the orderly withdrawal of the United Kingdom from the European Union of 8; December 2017 describes three different scenarios for the protection of North-South cooperation and the avoidance of a hard border, but that this Protocol is based on the third scenario of full alignment with the union`s internal market and customs union rules, which support now or in the future North-South cooperation, the economy of all islands and the protection of the 1998 Agreement; unless another arrangement is agreed to implement a different scenario.  He seems ready to avoid the backstop by other means – either by trying to renegotiate the deal with the EU, or by leaving the EU without a deal. The Irish Government supported the proposal.  The Democratic Unionist Party strongly opposed this because it weakens Northern Ireland`s place in the UK and is seen as the main reason why Theresa May`s withdrawal agreement was never approved by the British Parliament.  The UK government rejected the originally proposed text.
According to the Attorney General (the government`s chief legal adviser), this instrument has reduced the likelihood that the UK will be kept in the backstop against its will if the EU seriously blocks negotiations on future relationship agreements. Under the draft Withdrawal Agreement, the UK would enter a “transition period” after Brexit (currently scheduled for 31 October 2019). The Withdrawal Agreement and the new “instrument” on the backstop were rejected by Parliament in March 2019. The Withdrawal Agreement was rejected a third time this month. In October 2019, the new Johnson government renegotiated the bill and replaced the backstop. In the new protocol, the whole of the UK leaves the EU customs union as a single customs territory. Northern Ireland will be included in all future UK trade agreements, but will have no tariffs or restrictions on goods crossing the Irish border in either direction, creating a de facto customs border along the Irish Sea with Britain. .
